1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Ecco Forms (the "Service"), the waitlist marketing site at eccoforms.com, operated by WEALTHIVE LLC, a limited liability company organized under the laws of the State of Florida, United States ("Company," "we," "us," or "our").
By accessing or using the waitlist marketing site, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree, you must not use the Service.
You must be at least 18 years old to use the Service.
We may update these Terms from time to time. We will notify you of material changes at least 15 days in advance via email. Your continued use of the waitlist marketing site after the effective date constitutes acceptance of the updated Terms.
2. Definitions
- "Service" means the Ecco Forms waitlist marketing site at eccoforms.com.
- "User" means any individual who visits or submits their email address through the Service.
3. Description of Service
Ecco Forms is a pre-launch waitlist marketing site at eccoforms.com. The Service allows visitors to submit their email address to be notified when the Ecco Forms product launches. No paid plans, user accounts, file storage, or hosted landing pages are offered through this waitlist site.
4. Acceptable Use Policy
You agree to use the Service in compliance with all applicable laws and regulations. You shall not use the Service to:
- Submit fake or third-party email addresses to the waitlist;
- Submit content that is unlawful, defamatory, libelous, obscene, pornographic, or promotes illegal activities;
- Promote discrimination based on race, gender, sexual orientation, religion, nationality, or any other protected characteristic;
- Distribute malware, viruses, malicious scripts, or code designed to compromise the security of third parties;
- Conduct phishing, social engineering, or electronic fraud;
- Violate applicable data protection or privacy laws.
We reserve the right to remove submissions or block access for users who violate this policy without prior notice, in addition to any available legal remedies.
5. Intellectual Property
All intellectual property rights in the Service, including source code, design, trademarks, logos, and documentation, are and remain the exclusive property of WEALTHIVE LLC.
Nothing in these Terms grants you any license or right to the Service's intellectual property beyond the right to access and use the waitlist marketing site as a visitor.
6. Data Protection and Privacy
WEALTHIVE LLC acts as Data Controller for waitlist submissions. See Privacy Policy for details.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet all of your requirements.
8. Limitation of Liability
To the maximum extent permitted by applicable law, WEALTHIVE LLC shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities;
- Interruptions caused by force majeure events, including natural disasters, pandemics, government actions, or infrastructure failures beyond reasonable control;
- Failures of third-party services, including Cloudflare, DNS providers, and domain registrars;
- Unavailability resulting from cyberattacks exceeding commercially reasonable security measures.
IN NO EVENT SHALL WEALTHIVE LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE TOTAL AMOUNT PAID BY THE USER IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
The limitations in this section do not apply to liability arising from gross negligence, willful misconduct, or fraud.
9. Indemnification
You agree to indemnify, defend, and hold harmless WEALTHIVE LLC, its members, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) the email address or other information you submit through the waitlist; or (c) your violation of any third-party rights.
10. Term and Termination
You may request removal of your waitlist submission at any time by emailing contact@eccopages.com.
We may stop the waitlist or suspend access to the waitlist marketing site at any time and without notice if:
- Required by applicable law or a court order or governmental authority;
- We determine the waitlist is no longer operationally necessary.
Sections 5 (Intellectual Property), 7 (Disclaimer), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law) shall survive termination.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms that cannot be resolved through good-faith negotiation within 30 days shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in the State of Florida.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
12. General Provisions
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the parties regarding the Service and supersede all prior agreements, whether written or oral.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision.
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of WEALTHIVE LLC. We may freely assign these Terms in connection with a merger, acquisition, or sale of assets.
All notices under these Terms shall be sent via email and shall be deemed effective upon delivery.
